Court directs Maharashtra government to frame rules making it mandatory for cooperative societies to permit EV charging points for residents.
In a significant push towards India’s clean energy goals, the Bombay High Court has directed the Maharashtra government to draft rules ensuring that cooperative housing societies (CHS) allow residents to install electric vehicle (EV) charging stations in their designated parking spaces.
Background of the Case
This directive came following a petition filed by a businessman from Malabar Hill, whose housing society had refused permission to set up an EV charger. A division bench comprising Justices Girish Kulkarni and Advait Sethna issued the directive, which was officially released on Friday.
What the Court Ordered
The High Court has instructed the Registrar of Cooperative Societies to expedite the finalisation of draft rules related to EV charger installations. It also directed the Registrar to issue necessary directions under the Maharashtra Cooperative Societies Act, requiring societies to amend their by-laws once the rules are ready.
Why This Matters for EV Owners
The judgment is considered a major victory for EV owners, many of whom struggle to get society approvals for installing basic charging facilities. The court underlined the important role housing societies play in supporting the State’s broader environmental and sustainable mobility objectives.
Maharashtra’s Push for EV Adoption
Maharashtra is already promoting EV infrastructure. New residential projects are now required to provide EV charging points, with builders mandated to install a three-pin plug point at every parking slot—a norm being implemented in newly built complexes.
Public Interest and Environmental Benefits
The High Court stressed that facilitating EV adoption serves the larger public interest. It pointed out key advantages, including lower emissions, better air quality, stronger energy security, and reduced vehicle operating costs. The court also noted that Central and State governments are offering various subsidies and incentives to boost EV usage.
